A Penticton police officer who is facing charges under the Motor Vehicle Act in relation to the death of a five-year-old boy had his case appear briefly in court Oct. 12.

A single charge of driving a motor vehicle without due care and attention was sworn by Crown counsel on Sept. 9 against Const. Jimmy Ace Stewart after the Independent Investigations Office of B.C. (IIO) put forward consideration for charges in August.

The matter was adjourned on Oct. 12 in Penticton Provincial Court to Nov. 23.
