October judicial pre-trial scheduled for Penticton city councillor

A Penticton city councillor who is facing charges related to alleged historical sex crimes will have a judicial pre-trial in October. 

James Miller was charged in August in Sarnia, Ontario with two counts of sexual interference and two counts of sexual assault on a person under the age of 16 years old. 

The alleged incidents occurred in 1989 when Miller was a youth basketball coach in the Ontario community. 

Miller had an appearance scheduled in Sarnia's courthouse on Sept. 18, according to the court docket. 

The courthouse confirmed via email that Miller is scheduled to have a judicial pre-trial in October. 

According to the Ontario courts website, a judicial pre-trial is limited to the Crown, defence, and a pre-trial Judge. 

The judicial pre-trial is separate from a preliminary inquiry or trial. 

Following the judicial pre-trial, Miller is scheduled to appear in November in regular open court. 

The Sarnia courthouse also confirmed that no plea has been entered yet. 

Miller has been put on mandatory paid leave as a city councillor, and replaced on the Regional District of Okanagan Similkameen and Penticton Library boards.

He is also the managing editor of the Penticton Herald. A request for comment from the paper's publisher went unanswered, but according to the Okanagan Newspaper Group, Miller has been reassigned to desk duties.
